Q780: Question Regarding Niqaab

Question:

I have a question regarding niqaab.

  • what’s the ruling concerning niqab according to the hanafi rulings?
  • why is wearing niqab wajib and not farz?
  • what’s the difference between somethng being wajib and something being farz. farz means you have to do it so wajib means what, that its not a must?

Answer:

In the name of Allah, Most Compassionate, Most Merciful

The word ‘Waajib’ is an Academic term with a specific clarification.

Definition of Wajib

It is a category of compulsion the proof of which is Qatiuss suboot (expressly proven) and Zaniyyat dalaalah (indirectly indicative) or Qatiyyu ad-dalaalah(expressly indicative) and Zaniyyat as-suboot (indirectly proven).

Ruling

It is obligatory to act upon a wajib and one who does not act upon it is sinful just as he would be if neglecting a farz. In fact the Ulama have often refered to wajib as farz amali (farz with regards to action) however if a person rejects a wajib he will no bet regarded to have left the fold of Islam but rather he will be a Fasiq (sinner) unless he has a valid reason to do so for example he is a follower another mazhab and is adhering to it.

Example

To perform witr salah is wajib and if somebody chooses to reject this he is a sinner, however, if he is a follwer of another mazhab Eg. the Shafiee mazhab then he will not be a sinner (provided that he follows that mazhab in all of his issues and does not “pick and choose” according to his desires)

On the contrary farz is that the proof of which is both Qatiuss suboot (expressly proven) and Qatiyyu ad-dalaalah (expressly indicative). To act upon a farz act is obligatory and to reject it is kufr. For example the five daily salah’s are farz, to perform them is obligatory and anyone who rejects them will be considered to have left the fold of Islam.

With regards to your question the niqab is wajib and to act upon it Is obligatory and if a person rejects the hijab he will be sinful.

Note

Because of the apparent similarity between the two many Ulema often refer to farz as wajib and vice versa. This is not due to ignorance with the technical terms but rather because to act upon a wajib is obligatory just as it is to act upon a farz.
